A Chancery List CLCC decision subject to a pending application for permission to appeal to the Court of Appeal.
Myriam Stacey appeared for the successful claimant in a claim for possession which was defended on the basis that the land has been acquired by adverse possession. It involved a novel point of law as to the extent to which a person can acquire land by adverse possession which is underground and hidden from view. The case also involves issues of deliberate concealment.
