Landmark Chambers has a number of property specialists with considerable experience of dealing with cases involving mobile homes, park homes, and caravan sites. Members are regularly instructed on behalf of residents of sites, local authorities, and site operators to both advise and act for them in Court and Tribunal hearings.
Given the wealth of wider experience members of Landmark have in planning law and in property development and infrastructure projects, it is no surprise that a unique area of law that brings those concepts together, the law relating to mobile homes, park homes and caravan sites, is an area where Landmark members have appeared in some of the leading cases in the Upper Tribunal and Court of Appeal.
The deep understanding of the specific and perhaps unique situation park site owners find themselves in, allows members of Landmark to advise and act for them in matters which may involve general land law such as boundary disputes, nuisance claims, and the proper interpretation of documents such as site rules, licences and written statements, as well as in specialist and esoteric points arising from the statutory control imposed by the Caravan Sites Act 1968 and the Mobile Homes Act 1983.
Members of Landmark have appeared in the FTT, the Upper Tribunal and the Court of Appeal on cases relating to site licences, whether planning permission and site licence conditions allow permanent or holiday occupation, the definition of a mobile home, and pitch fees for both site owners and residents. A particular area of expertise is in securing permission for the extension of sites by a number of methods, including but not limited to obtaining certificates of existing lawful use or certificates of proposed use or development.
Members of Landmark have also regularly acted on behalf of local authorities with regard to their obligations to regulate sites, including challenges to their authority and the decisions made, brought by developers, site owners and occasionally neighbours and residents.
