Scottish Widows v Stewart [2006] EWCA Civ 999

The Court of Appeal overturned the trial judge's finding that there was sufficient evidence that a cause of action had been assigned by one company in the control of one director and shareholder to another company under the control of the same man. The court also upheld the judges finding that an agreement to occupy business premises for 8 days made between one company and another did not constitute a tenancy."
