Richard Drabble QC, David Forsdick QC and Jonathan Wills successfully acted in the Court of Appeal in an important case relating to the discretion to quash a planning permission where the development has been carried out.
It had been an error to quash a grant of planning permission for a solar farm given that there was no sufficient reason for a householder's delay in bringing judicial review proceedings, and the developer would have otherwise suffered a multi-million pound loss, as it had built out the development.
