Acted for the operator in one of the very few reported decisions under the old Electronic Communciations Code. The dispute involved a development agreement and raised allegations of breach of the operator’s contractual obligations to use reasonable endeavours to relocate of telecommunications apparatus. Created new law as to the interrelation between statutory rights and contractual provisions. The claim for breach of reasonable endeavours obligations settled shortly before trial.
