In McCabe v Secretary of State for Communities and Local Government[2007] EWHC 959 (Admin), Goldring J. rejected a challenge (under s. 23(1) of the Acquisition of Land Act 1981) to the vires of the Urban Regeneration Agency (Lime Street Gateway, Liverpool) Compulsory Purchase Order 2005 made by English Partnerships under s. 162(1) of the Leasehold Reform, Housing and Urban Development Act 1993.
This was the second time in recent months that the Courts have considered the scope of the powers under the 1993 Act: see Pascoe v Secretary of State [2006] 4 All ER 1240.
