Chancery Division holds that an option granting a sub-lessee the right to an extension lease for a term of 60 years was capable of being assigned to a building society by way of mortgage and that Parliament did not intend the Perpetuities and Accumulations Act 1964 s.9(1) to prevent an option being assigned by way of mortgage to a chargee of the relevant lease.
