Delaney v Secretary of State for Communities & Local Government and Basildon Borough Council

The Court of Appeal rejected a challenge to an Inspector's approach to temporary planning permission in circumstances where, contrary to its statutory duty, the local authority has failed to carry out an assessment of the accommodation needs of Gypsies and Travellers in its area and to prepare a strategy in respect of the meeting of that need.
