Court of Appeal uphold the partial quashing of the New Forest National Park Designation

In Meyrick Estate Management & Others v The Secretary of State for Environment, Food and Rural Affairs the Court of Appeal ([2007] EWCA Civ 53) gave judgment today upholding the decision of Sullivan J. ([2005] EWHC 2618 (Admin)) to quash (in part) the New Forest National Park (Designation) Order 2002 ("the Order") as confirmed by the Secretary of State for Environment, Food and Rural Affairs. As well as considering the 1949 Act as it was in force at the time of the confirmation of the Order the Court of Appeal also considered the new provisions inserted into the 1949 Act by the Natural Environment and Rural Communities Act 2006 in response to the judgment of Sullivan J. David Elvin QC and James Maurici appeared for the Secretary of State for Environment, Food and Rural Affairs.
