Challenge to new Tesco store rejected

The High Court has today handed down judgement in Salford Estates v Durham County Council and Tesco Stores Ltd, a challenge brought by the owner of the Castle Dene shopping centre in Peterlee, to the County Council’s decision to grant permission for a new 10,000m2  Tesco store on the edge of the town centre.  The Court rejected the claim on all grounds and refused Salford’s application for permission to appeal to the Court of Appeal.  The Court has yet to determine a further challenge, also brought by Salford Estates,  to the County Council’s decision made at the same committee meeting to grant permission for a new superstore-led mixed use scheme at nearby Dalton Park.
