BDW Trading Ltd v Opticliffe Ltd [High Court- Chancery Division]

Dispute over whether housebuilder was entitled to serve a notice to complete. Bulk sale of 59 flats agreed at peak of market, with completion falling due at bottom of the market in 2008. The purchaser claimed that it was not obliged to complete because the specification of the floors had been varied, and because pre-occupation planning requirements not met. Decision contains useful analysis of requirements for valid notice to complete, and of effect of departures from strict requirements of contract.
