Barker v Pinsent Masons LLP

Robert Walton acted for Pinsent Masons LLP (PM) in respect of a three week High Court professional negligence claim.  The Claimant, Mr Barker, alleged that PM had acted negligently in failing to file a claim within the 6 week statutory time limit in respect of a claim Mr Barker intended to bring under s.113 of the Planning & Compulsory Purchase Act 2004 in respect of the adoption by Hambleton District Council of its Allocations DPD in December 2010.  Mr Barker claimed that had the claim been brought in time the High Court would have quashed the DPD, following which the Council would have allocated substantial parts of Mr Barker's land for housing, pusuant to which he would have made more than £20m profits.  Robert was instructed in relation to the planning and valuation aspects of the claim.
