The Supreme Court (Lord Neuberger; Lord Hope; Lord Mance; Lord Carnwath and Lord Clarke) today heard further argument in the case of R. (Edwards) v Environment Agency & Others.
This follows the ruling of the Court of Justice of the European Union in Case C-260/11 (on 11 April 2013) in response to a reference made by the Supreme Court in this matter on 15 December 2010 ( 1 W.L.R. 79).
The case concerns the meaning of not prohibitively expensive in the context of environmental proceedings covered by Directive 2003/35/EC the Public Participation Directive.
