The Supreme Court have refused permission to appeal in the case of Smyth v Secretary of State for Communities & Local Government.

The long running case of Smyth concerning SANGS and the Habitats Directive has now come to an end.

The decision of Patterson J. dismissing the claim ([2013] EWHC 3844 (Admin)) was in December 2013. The Court of Appeal dismissed the appeal ([2015] EWCA Civ 174) in March of this year.

The Supreme Court on 16 July refused permission to appeal.
