The Supreme Court has allowed the appeal by Heathrow Airport Limited against the Court of Appeal’s decision in February 2020 that the Airports National Policy Statement should have no effect unless and until it was reviewed to further consider climate change matters. The Supreme Court found that the Divisional Court was correct to dismiss the claims by Friends of the Earth Limited and Plan B Earth, and that the Secretary of State for Transport had acted lawfully in considering climate change issues in the designation the ANPS.
