Riverside Lodge Freehold Limited v Centreway Investments MAN/00BN/OCE/2020/0011

This was a collective enfranchisement claim relating to two blocks of flats in Manchester known as Riverside Lodge. The landlord claimed development value of close to £200,000 for the potential to build six extra flats on the roofs. The main issues were whether planning permission would be granted, and what the proposed development would cost. After a five day hearing and evidence from planning, quantity surveying and valuation experts the Tribunal accepted the tenants’ evidence that the hypothetical purchaser would have concluded that the development was not viable. It allowed a “gambling chip” of £10,000 for the hope of some future development.
