Successful defence of the Adoption and Children (Coronavirus) (Amendment) Regulations 2020, which temporarily modified certain duties in the field of children’s social care at the start of the Covid-19 pandemic. The judge held that the Regulations were consistent with the statutory purpose of protecting children and the Secretary of State’s duty to have regard to the welfare of children, and that the consultation had been adequate in the exceptional circumstances faced by the Government at the time. The latter finding was subsequently overturned by the Court of Appeal, but the Regulations were not quashed.
