Portman Estate v Jamieson LON/00BK/OAF/2014/2015

Tom acted for the tenants in a claim for the freehold of 7 Montagu Mews West, a house on the Portman Estate, under the Leasehold Reform Act 1967. After the lease was granted in 1957 the original Victorian mews building, which was partly connected to the main house at 7 Bryanston Square, was substantially demolished and rebuilt. The issue, worth £1m, was whether the construction of the new house should be disregarded as an improvement. The First Tier Tribunal accepted the tenants’ legal and valuation case in its entirety. Portman have appealed to the Upper Tribunal. The decision is available here. Tom Jefferies represented the tenants, instructed by Maxwell Winward LLP.
