Graeme represented Gleeson Land at a six-day inquiry against the refusal of outline planning permission for 133 dwellings. The reasons for refusal included effects on: heritage; landscape; and the highly controversial issue of water neutrality. Two Rule 6 parties raised further substantive issues including: flood risk/drainage; highways; ecology; and loss of agricultural land. These issues required calling experts and cross-examination. The appellant’s case on water neutrality mitigation was subject to a late change (for reasons outside its control) prior to the inquiry and required lengthy and detailed legal submissions on Grampian conditions, s.106 obligations and compliance with the habitats regulations.
