Homes (Fitness for Human Habitation) Act 2018

The Homes (Fitness for Human Habitation) Act 2018 comes into force today. It updates the moribund provisions in s.8, Landlord and Tenant Act 1985 so that any new residential tenancy (secure, assured or contractual) has a term implied into the tenancy agreement to the effect that the landlord must ensure that the property is fit for human habitation both when let and for the duration of the tenancy. Breach can be enforced by the tenant through a county court claim for damages and/or an injunction. It also updates the concept of "fitness" in s.10, 1985 Act by incorporating the Housing Health and Safety Rating System (Pt.1, Housing Act 2004).
