High Court rules on East Anglia offshore windfarm developments

The High Court has handed down judgment in a judicial review challenge to the grant of development consent under the Planning Act 2008 for the East Anglia ONE North and East Anglia TWO offshore wind farms, two nationally significant infrastructure projects. In R (Substation Action Save East Suffolk Ltd) v Secretary of State for Business, Energy and Industrial Strategy [2022] EWHC 3177 (Admin), the Claimant challenged the respective development consent orders on six grounds relating to flood risk, heritage, noise, generating capacity, cumulative effects and alternative locations. On 13 December 2022, Lang J dismissed the claim on all grounds. Richard Turney and Charles Bishop acted for the Claimant, instructed by Richard Buxton Solicitors. The judgement is available here.
