High Court hands down landmark judgment on EU citizens’ rights in the UK

The High Court has today handed down judgment in R (Independent Monitoring Authority for the Citizens’ Rights Agreements) v Secretary of State for the Home Department [2022] EWHC 3274 (Admin), a challenge by the IMA to the government’s implementation of the citizens’ rights provisions under the UK-EU Withdrawal Agreement (“WA”). The IMA is the post-Brexit citizens’ rights watchdog established under the WA to monitor and protect the rights of EU citizens and their family members in the UK. This was the first case brought by the IMA as a claimant in its own right.

Further background to the case is set out here. Lane J has today upheld the IMA’s claim but has granted the Secretary of State permission to appeal to the Court of Appeal.
