Court of Appeal hears RAF Wethersfield s. 187B appeal

Today, the Court of Appeal will hear Braintree District Council’s appeal from the decision of Waksman J dismissing its application for a S. 187B injunction to halt the Home Secretary’s plans to use land at RAF Wethersfield to accommodate asylum seekers.

West Lindsey District Council, Rother District Council and Gabriel Clarke-Holland (a local resident) have been granted permission to intervene in writing.

The two issues are: the ambit of the prohibition on commencing enforcement proceedings against the Crown on Crown Land under s 296A; and the scope of Class Q in the GPDO. Two of the intervenors have asked the court not to determine the second issue.

Paul Brown KC and Nick Grant appear for the Secretary of State.
