The Court of Appeal has now delivered judgment in the secure tenancy succession case of Simawi. Stephen Knafler QC appeared for the appellant, Mr Simawi, leading Toby Vanhegan and Hannah Gardiner of 4-5 Grays' Inn Square. The Court of Appeal dismissed the appeal on the basis that the secure tenancy succession rules did not treat family members differently "on the ground of" their status and, if they did, the different treatment was justified. Mr Simawi is applying for permission to appeal to the Supreme Court. This may be an opportunity for the Supreme Court to consider the recent ECtHR case of JD and A v United Kingdom.
