Abergavenny Livestock Market judicial reviews fail

The High Court (Nicola Davies J.) today dismissed two judicial reviews (CO/3488/2012 R (Long) v Welsh Ministers & Others; CO/1095/2012 R (Long) v Monmouthshire County Council & others) brought by Keep Abergavenny Livestock Market or “KALM” seeking to prevent the redevelopment of the livestock market in Abergavenny. The livestock market is to be moved out of town and the current site redeveloped for a Morrisons supermarket and new library. The first judicial review sought to challenge the decision of the Welsh Ministers to make an order (the Abergavenny Improvement Act 1854 (Repeal) Order 2012 “the Order”) under s. 58(2)(d) of the Local Government (Wales) Act 1994. The Order repealed various provisions in the Abergavenny Acts which arguably required that the livestock market be held within  a defined area. The second judicial review sought to challenge the grant of planning permission for the proposed redevelopment of the current live stock market site.
