Judicial review challenge to A428/A1 Black Cat roundabout road scheme refused permission

Sir Ross Cranston has today refused permission for the action group, Transport Action Network Ltd (TAN), to challenge a Development Consent Order granted by the Secretary of State to National Highways Ltd for the ‘A428 scheme’ which includes major upgrades to the A1 Black Cat roundabout and Caxton Gibbet junction to the east and the provision of a new 10 mile connecting dual carriageway.  TAN sought permission for judicial review on grounds relating to potential hedgerow loss, need and carbon emissions.  Following an oral renewal hearing yesterday, the Court has today ruled that all grounds are unarguable and has refused permission for the judicial review to proceed.
