Judge dismisses challenge to the Wards Corner Regeneration Project CPO

On 14 September 2016, the London Borough of Haringey (“LBH”) made a compulsory purchase order (“CPO”) to facilitate the regeneration of land at Seven Sisters Road (above the underground station). The regeneration aims to provide new housing and retail facilities, as well as a new home for the Seven Sisters Latin American Market. The market has a rich history and its retention has been a particular focus for LBH in promoting regeneration of this site. The Secretary of State confirmed the CPO on 23 January 2019, following an inquiry that was held over 10 days in July 2017. The Secretary of State’s decision was challenged in the High Court on several grounds relating to whether the protections offered to the market traders had been properly understood, and whether proper consideration had been given to the human rights of the market traders, and their children, who have enjoyed the cultural benefits offered by the market. In a judgment delivered on 10 October 2019, Jay J dismissed the challenge on all grounds. Tim Corner QC and Andrew Byass acted for LBH at both the inquiry and in the High Court proceedings.
