Supreme Court hearing Airports NPS appeal

The Supreme Court is hearing (on 7 and 8 October) the appeals by Heathrow Airport Limited against the Court of Appeal's decision in February 2020 that the Airports National Policy Statement should have no effect unless and until it is reviewed to further consider climate change matters. The appeal raises a number of important issues in respect of the operation of the Planning Act 2008, and the approach to be taken to unincorporated international treaties, specifically the Paris Agreement. The hearing is being conducted remotely but streamed via the Supreme Court website. Richard Turney acts for the appellant, Heathrow Airport Limited, led by Lord Anderson KBE QC and Michael Humphries QC. Andrew Parkinson acts for the first respondent, Friends of the Earth Limited, led by David Wolfe QC.
