• The Supreme Court’s views on the role and function of the National Planning Policy Framework;
• The meaning and effect of paragraph 49 of the National Planning Policy Framework;
• In particular, the correct approach to determining what are “relevant policies for the supply of housing”;
• The relationship between the “presumption in favour of sustainable development” at paragraph 14 of the NPPF and the statutory presumption in favour of the development plan at section 38(6) of the Planning and Compulsory Purchase Act 2004.
