Acted for the developer and secured planning permission for a residential development on brownfield land at Swindon. The case involved contested viability evidence in which the developer resisted the s.106 contributions and affordable housing contributions sought by the council on the grounds that the scheme would not be viable if such requirements were imposed.
The case also included issues about design and whether a residential only scheme was acceptable in the location proposed.
