4 day Inquiry (appeal recovered by Secretary of State). Graeme promoted the residential development of the site (a large area of greenfield land on the edge of a village in W Sussex) for up to 100 dwellings and a large area of public open space. The Inquiry involved detailed heritage issues (the site is within the setting of a Grade I listed church and a conservation area), planning policy, housing land supply, landscape and visual impact and archaeology. The appeal was recovered by the SoS primarily because it was contrary to a Neighbourhood Plan (which had recently been “made” by the date of the Inquiry). The Inspector appointed to hold the Inquiry recommended permission be granted. Despite accepting the Inspector’s conclusions as to all the other main issues, the Secretary of State refused permission solely on the basis of conflict with an out of date neighbourhood plan policy. S.288 challenge dismissed in March 2017.
