Church Lane Wistaston

Graeme represented the local planning authority (at a 2 day Hearing), defending a recovered appeal against non-determination for a scheme of up to 300 dwellings in Wistaston. The appeal scheme is a duplicate of a scheme recovered by the Secretary of State and refused permission in 2015 for a number of reasons, including: erosion of a Green Gap; landscape harm; loss of best and most versatile agricultural land; the fact that the site was promoted for inclusion within an area promoted for Green Belt designation in an emerging local plan; and on prematurity grounds (on the Green Belt issue). Since that decision, the local authority decided not to promote the Green Belt designation and the main issue at appeal related to the planning balance, once the Green Belt/prematurity point was removed. Permission granted by SoS.
