Charlie Butler Public House, Mortlake High Street, London

This case concerned the proposed demolition of public house and erection of an architect-designed block of 9 apartments adjacent to the Mortlake Conservation Area. The Council’s putative reasons for refusal (the appeal having been brought against the non-determination of the application within the required period) included the alleged impact of the development on the Conservation Area, design, impact on the privacy of nearby properties, and the impact on a TPO’d tree on Mortlake High Street. Following a two-day inquiry, the Inspector’s decision letter dated 26 March 2013 allowed the appeal and granted planning permission.
