Stephen Whale successfully represented the former Head of Care at a specialist school, following earlier successes in the employment tribunal and the Employment Appeal Tribunal in the course of the same litigation. The Court of Appeal concluded by a majority that there had been no unfairness by the employment tribunal, and that there was nothing perverse in its judgment. This latest judgment provides useful guidance on the limits of the Burns/Barke procedure.
