Trail Riders Fellowship v Devon County Council

Stephen Whale successfully represented the County Council in connection with a challenge to a traffic regulation order it had made under section 1 of the Road Traffic Regulation Act 1984 prohibiting motor vehicles from using a stretch of country road.  There were eight grounds of challenge, encompassing not only sections 1 and 122 of the 1984 Act but also the 1996 Regulations on the procedure for making traffic regulation orders, section 130 of the Highways Act 1980 and section 16 of the Traffic Management Act 2004.
