Spaces Personal Storage v RSN [Central London CC] HHJ Cowell

Dispute over whether adjoining owners had acquired a right to park on a private road to an industrial estate, and what control the owner of the road could impose on any parking. Interesting issues as to whether a right to park could be claimed notwithstanding covenants not to park, whether it could be claimed over the whole road, and whether it was too extensive to amount to an easement. The court found that rights had been acquired, but went on to declare that the landowner was entitled to impose a scheme to prevent unauthorised parking and limit the times during which parking could take place. Thomas Jefferies acted for the landowner.
