This was the Secretary of State's appeal against the decision of Collins J., who had quashed a planning inspector's decision inter alia on the ground that the Inspector's previous employment at the County Council, which was an objector to the proposal gave rise to an appearance of bias. Although the Court of Appeal upheld Collins J.'s decision, it significantly cut back the circumstances in which claims of bias based on previous employment are likely to succeed.
