Case

Rudi v Secretary of State for the Home Department

Important case involving a rationality challenge to the Secretary of State's policy to grant indefinite leave to remain to families meeting certain criteria but which had the effect of excluding young persons who, but for the fact that they had arrived without their parents, as unaccompanied minors, would also have fallen within the policy.  A case about justification and bright line rules.  CA decided to follow an earlier decision on a similar point which is pending before the House of Lords.  The Appellant in this case is petitioning the Lords at the moment to join it.  My solicitor: Karlie Dickinson from the Treasury Solicitors. I appeared against Mark Henderson.
