Regan v Paul Properties DPF No 1 Ltd & Others 2006 EWHC 1941

The Claimant claimed injunctions and damages against the Defendants in the tort of nuisance, for allegedly having infringed his rights to light by constructing a mixed commercial and residential development across the road from his home in Brighton. After careful consideration Stephen Smith QC (sitting as Deputy Judge of the Chancery Division) awarded he Claimant (represented by Stephen Bickford-Smith)damages in substitution for an injuction.
