I advised the claimant and settled judicial review proceedings which challenge the inconsistency in the government's approach to the definition of "municipal waste" for the purpose of the Landfill Allowance Trading Scheme. The claim is ongoing. Permission was granted by Sullivan J but it has been stayed because the Secretary of State is consulting on possible changes to the definition of municipal waste. At the present time, it remains to be seen whether the consultation will resolve the issues raised in the case.
