R (Walumba Lumba) v Secretary of State for the Home Department [2008] EWHC 2090 (Admin)

Collins J. held that a national of the Democratic Republic of Congo continued to be detained lawfully under the Hardial Singh principles in spite of the length of time that had elapsed during which he had been in detention and the problems with effecting his deportation. The judgment is the subject of appeal. The outstanding question of the legality of an unpublished policy of presuming to detain foreign nationals falls to be considered in September and October 2008 in this and four other joined cases.
