R. v Durham CC Ex p. Huddleston

Successfully acted for Durham County Council in arguing that there had been a failure in the transposition of the Environmental Impact Assessment Directive in the Old Mining consent provisions of the Planning and Compensation Act 1991. Important case relating to the boundaries of "direct effect" that resulted in a statutory provision being disapplied by the Court. Solicitor: Council Solicitor. Opponent was David Elvin QC
