Judicial review challenging variation of s.106 agreement on a s.73 application.  S.73 permission quashed on the basis that the claimant should have had an opportunity to comment on the proposed varied s.106 agreement.  Contention that the change to the planning permission (increase in number of units) could not be made under s.73 rejected.
