Chris Jacobs acted for the 11 members of the Dale Farm Housing Association in a high profile 4 day hearing in the Administrative Court. The travellers sought to remain at the Dale Farm site pending the determination of two planning applications, which would have enabled them to transfer to a legally occupied site in accordance with the District Council’s obligations under the Regional Spatial Strategy. It was argued on behalf of the travellers that the upheaval of a forced eviction would breach provisions in the Children Act and Article 8 ECHR. The hearing of the applications was expedited and he evictions stayed pending the outcome. Christopher represented the same travellers in an appeal against the judgment of Ouseley J before the Court of Appeal.
