R (on the application of Lensbury Ltd) v Richmond Upon Thames LBC [2016] EWCA Civ 814

Christopher Lockhart-Mummery QC acted for the appellant in a judicial review of the grant of planning permission by the Respondent (a local authority) for development in Metropolitan Open Land. It was held that the local authority  had failed to assess whether a planning application was "inappropriate development" under local policy. It consequently failed to ask itself the critical question whether "very special circumstances" existed which justified the grant of planning permission 21 Jul 2015.
