The permanent exclusion of a year nine pupil for a one-off incident during which she forced open a door and pushed a teacher, causing her to fall against a desk, was overturned because the local authority's appeal panel had failed to consider whether she was guilty of "serious actual or threatened violence" under the terms of government guidance on exclusions. It had also failed to follow the guidance on managed moves to another school. Acted for the pupil.
