R (on the application of Kakar) v Secretary of State for the Home Department [2015] EWHC 1479 (Admin)

The secretary of state had been unreasonable or irrational to conclude that there was no realistic prospect of success for a fresh asylum claim where the claimant had submitted a more detailed witness statement and further medical reports about his deteriorating mental state, both of which could plausibly have led a tribunal to a different conclusion.
