Successful appeal against the Upper Tribunal’s finding that the Secretary of State for the Home Department had not acted unlawfully when he made a deportation order against a Somali national. The order was void ab initio and had not invalidated his existing leave to remain. Accordingly, an outstanding application for indefinite leave to remain had to be determined.
