Price v Leeds

House of Lords, 2006. Instructed by Leeds City Council (Karen Blackmore). My junior was Tom Tyson. The opposing Silks were Jan Luba QC and Philip Sales QC. This is the leading case on two quite distinct points. Firstly, it establishes that Article 8 ECHR can never be a defence in domestic proceedings for possession by a public body. Secondly, it establishes that the domestic system of precedent is unaffected by decisions of the European Court of Human Rights.
