Pitalia v NHS Commissioning Board

This was the first case to go to the Court of Appeal to consider the legal effect of an “NHS Contract”.  It also considered whether the changes made to NHS contracts in 2004 had the effect of changing the status of an NHS contract to a legally binding contract and the wider consequences for NHS Providers of changing the status of an NHS contract to a legally binding contract.
